1 General

Nodalview values privacy and is therefore committed to protect the (personal) data of all its stakeholders with the greatest possible care, and to process personal data only in a fair and lawful manner.

This privacy policy (“Privacy Policy”) governs the processing of your personal data as a part of your use of our Website (the “Website”) and the accompanying services (jointly referred to hereinafter as “Services”).

This processing is performed by NODALVIEW as data controller, with a registered office at Avenue Louise 523, 1050 Brussels, Belgium ("we”, “our"), listed with the CBE (Crossroads Bank for Enterprises) under the number BE0823.015.207 in accordance with the applicable legislation relating to the protection of personal data.

We undertake to protect and process your personal data with due care, transparently and in strict compliance with data protection legislation. As from 25 May 2018, the new Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – “GDPR”), and repealing Directive 95/46/EC, is in force. We process your personal data in accordance with the GDPR and national regulations (“data protection regulations”).

2 Scope of the Privacy Policy

This Privacy Policy is applicable to our customers, partners and website visitors for the personal data collected and processed by Nodalview through this website and the related services.

This Privacy Policy contains essential information on how Nodalview, as the data controller, collects and processes personal data, for what purposes and explains your rights as a data subject.

3 Purpose, legal ground and data collected

3.1 Recruitement

Processing your application for a Job at Nodalview. If you submit your application to us, you consent to processing your data to review your application and contact you in that regard.

We draw your attention to the fact that, for our recruitment process, we do not need to collect sensitive data about you, such as data revealing your race or ethnic origin, your political, religious or philosophical opinions, your union membership, your health or your sex life. Be aware that if you choose to provide us with unsolicited sensitive data spontaneously (for example in your motivation letter or during the interview), you do so under your own responsibility, and we will not take it into account during the recruitment process.

3.2 Marketing

Social Media

Nodalview has a page on various social networks, such as namely Facebook, Instagram, LinkedIn, Twitter and Youtube. These pages are used to inform you about our news and, if so, contact you if you ask us a question via e-mail or comments. If you send us personal data via a social network’s messaging, it is only used to answer your question or to follow up on your request. We then process your personal data based on our legitimate interest in communicating with visitors to our page.
These social media act as a Joint Controller with regards to the processing of your personal data. For more information about the way they can process your data, please refer to their privacy policies.

Events

When you sign up for and participate in one of the events we host, we process some of your personal data based on your consent to process your data to manage/organize the event you want to attend.
During our events, we are likely to take ambiance pictures (e.i. pictures that capture the mood of an event but not subjects in particular). We are also likely to take picture in which people are recognizable. In such a case, these pictures can only be taken with your consent.

Text me the app

We provide the possibility to text you a download link for our app. To do this, we will ask for the following information:

We use this information to text you the download link to the app.

If you could potentially be benefited by one of our product offers, we might call you to check how your trial is going and if you would be interested in our full product. If you don’t want to be called by us anymore, you can always request us to stop calling you.

Trial Signup

If you sign up for a free trial through our app or web platform, we will ask at least for the following data:

  • Personal identification data: first name, last name
  • Contact details: email address, phone number
  • Job title, signup goal

We use this information to send you emails that should help you get the most out of your free trial of our product. You can always opt out of email communication through links provided in the emails we send or by asking us.

If you could potentially be benefited by one of our product offers, we might call you to check how your trial is going and if you would be interested in our full product. If you don’t want to be called by us anymore, you can always request us to stop calling you.

Ebook Downloads

If you want to download any of our ebooks we are asking for some of your data. This will probably include

  • Job title

We use this information to send you the ebook through email. We might also send you a few marketing emails that are related to the topic of the ebook. You can always opt out of email communication through links provided in the emails we send or by asking us.

Webinars

From time to time, we organize webinars. If you want to join one of those we will ask for some of your data. This will probably include:

We use this information to send you an invite link and possibly some reminders for joining the webinar. We might also send you a few marketing emails that are related to the topic of the webinar. You can always opt out of email communication through links provided in the emails we send or by asking us.

3.3 Newsletter

Newsletter. Nodalview can send you its newsletter if you have given your consent to us processing your data for that purpose. If you no longer wish to receive our newsletters, you can withdraw your consent at any time, via the link built directly into each newsletter. For more information about the right to withdraw consent, please refer to the section “8. Your rights” of this policy.

Browsing our website – Essential cookies. These cookies are strictly necessary to allow the user to move around the site or to provide certain requested functionalities. These cookies are installed based on legitimate interest.

3.5 Contract

Service contract. When you participate in and/or execute a contract with Nodalview, we collect information from our suppliers and partners in order to execute this contract.

  • Any other information we may need to fulfill our obligations of the contract

3.6 Legal obligations

Compliance with legal obligations. If legally requested by a competent authority, Nodalview can transmit your personal data to the police or the judicial authorities as proof of possible crimes or if there are founded suspicions of an unlawful deed or crime that you committed by means of your registration in or the use of the Website or the Services.

3.7 Client relationships

Processing your request or complaint. When you send us a request and you share your contact information with us for this purpose (whether through our contact or complaint forms on our website or any other communication channel), we use your data to respond to your request by contacting you. We then process your identification and contact data, as well as the content of your message, because you consent to it by sending us your request. We only use this information to deal with your question or complaint to the extent needed.

4 Disclosure of your data to third parties

As a general rule, personal data will not be made public, sold or passed on to other organizations, except to comply with legal obligations and in case of explicit request from judicial authorities or police forces. In the exceptional case where Nodalview transmits personal data to other organizations, this is explicitly indicated when the data is requested or when the explicit consent of the person is requested.

However, personal data may also be shared with processors to whom Nodalview has entrusted certain processing activities. In this case, a data processing agreement is always concluded between Nodalview and the processor to ensure that they offer the same data protection safeguards as Nodalview. We ensure that personal data is only processed by processors for the purpose for which it was collected. The processor is obliged to respect all legal obligations and instructions from Nodalview.

5 Processing location of your data

In case we transfer your personal data to a third country or international organisation (i.e., outside the EEA), we will make sure that your personal data is either transferred to third countries that are deemed to be offering an “adequate” level of protection by the European Commission (a list of adequate third countries is available on the European Commission’s website), or alternatively, where your personal data is not sent to a country that provides an adequate level of protection, we will put in place appropriate safeguards with the entity receiving your personal data (e.g. the EU standard contractual clauses or binding corporate rules) to ensure that your personal data remains protected in accordance with Applicable Data Protection Law.

In these specific cases and through the following organisations, a transfer will take place outside the EEA (European Economic Area):

6 Security measures applied to your data

Nodalview has taken technical and organisational security measures to prevent the destruction, loss, falsification, alteration, unauthorized access or disclosure of your personal data to third parties and any other unauthorised processing of these data.

We have made every effort to ensure the confidentiality, integrity and availability of the information systems and services that process personal data. These measures include physical and operational security measures, access control, awareness raising and confidentiality clauses. All our employees and third parties engaged by us are obliged to respect the privacy and security of your data.

7 Retention of your data

Nodalview does not store or process personal data longer than necessary for the purposes for which it was collected. In particular, your personal data will be stored in our systems for as long as is reasonably necessary to provide our services.

The data retention period varies according to the nature of the service provided. We retain your data:

  1. In case the processing of your personal data is based on your consent:
  • For as long as is necessary for the relevant purpose for which you gave your consent.
In case the processing of your personal data is based on our legitimate interest:
  • For as long as is necessary to fulfill the purposes for which your data is collected and processed.
  • For as long as is necessary to carry out our business operations.
In case the processing is based on legal obligations;
  • For as long as is necessary to comply with our legal, contractual and statutory obligations

We guarantee to give only limited access to the archived data and to delete or make anonymous your personal data if the retention period has expired.

8 Your rights as a data subject

Under GDPR, data subjects have the possibility to exercise his or her rights as described in the General Data Protection Regulation. The data subject can exercise the following rights:

8.1 Right of access

You have the right at any time and free of charge to access your personal data and to request a copy of the personal data that Nodalview collects about you.

8.2 Right to rectification

You always have the right to have incorrect personal data corrected, or incomplete personal data completed.

8.3 Right to erasure (“right to be forgotten”)

You can request to have your personal data erased from Nodalview’s systems. The request to erase your personal data cannot always be granted due to contractual or legal obligations. Nodalview will take these obligations into account when replying to your request.

8.4 Right to object

You have the right to object to the processing of your personal data if the processing takes place on the ground of the legitimate interest of Nodalview or on the ground of the public interest. We will stop processing unless we can prove that there are compelling legitimate grounds for the processing or for the exercise of legal claims. You can also object in the case of direct marketing, so the personal data will no longer be processed for these purposes.

8.5 Right to withdraw consent

For the processing of your personal data collected by Nodalview with your consent, you can withdraw your consent at any time. For example, you can always unsubscribe from the newsletters. However, the withdrawal of your consent does not apply to processing previously carried out by Nodalview.

8.6 Right to restriction of processing

In certain cases, the data subject is entitled to obtain the restriction of the processing of his or her personal data. We will continue to store your data, but we will restrict its use. You can e.g. submit this request when you think that your personal data is inaccurate, or the processing by Nodalview is unjustified. We only have to grant these requests in specific cases as defined by law.

8.7 Right to data portability

The data subject has the right to receive the personal data concerning him or her, processed by Nodalview, in a structured, commonly used and machine-readable format and/or to transmit those data to another controller. These rights can be exercised free of charge by sending an e-mail to info@nodalview.com.

We commit to answer your request within one month upon its receipt. It is possible that we request additional information first in order to confirm your identity and ensure the request originates from you.

8.8 Right to lodge a complaint

In addition, if you have any complaints about the way Nodalview processes your personal data, you can file a complaint with the Belgian Data Protection Authority at Rue de la Presse 35, 1000 Brussels or electronically via: https://www.dataprotectionauthority.be/citizen/actions/lodge-a-complaint

10 Modifications

When we publish changes to our Privacy Statement, we will change the date and version number of the “last update” of our Privacy Statement. Significant changes will be reported on our homepage. Nevertheless, we encourage you to read our Privacy Statement periodically.
